Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Calfo mobile application and related services (the "Service"), provided by Acosta Tech LLC ("Calfo," "we," "us," or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Calfo is a native iOS application that helps you manage your pantry and fridge inventory, track expiry dates, and discover recipes based on the food you already have. Some features rely on your device's camera and on third-party services described in our Privacy Policy.

2. Eligibility

The Service is not directed to children. You must be at least 13 years old to use the Service, and at least 16 years old in regions where 16 is the minimum age for digital consent. By using the Service, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms.

3. Your Account

You may begin using the Service with an anonymous session before creating a full account. When you create a permanent account, you provide an email address, and authentication is handled by our service provider. You are responsible for safeguarding access to your account and for all activity that occurs under it. You agree to provide accurate information and to keep it up to date.

4. Calfo Pro Subscription

Calfo offers an optional auto-renewing subscription called Calfo Pro. The Service is usable for free, and Calfo Pro unlocks additional features, including AI fridge scanning and household sharing.

Pricing

Calfo Pro is offered at $5.99 per month or $49.99 per year. The annual plan may include a one-week free trial. Prices are stated in U.S. dollars; prices in other regions and any applicable taxes are shown in the App Store at the time of purchase.

Billing, Auto-Renewal, and Cancellation

Calfo Pro is an auto-renewable subscription billed through your Apple App Store account. By the standard App Store subscription terms:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours prior to the end of the current period, at the rate of your selected plan.
  • You can manage or cancel your subscription at any time in your Apple ID account settings (Settings › your name › Subscriptions on your device). Cancellation takes effect at the end of the current billing period.
  • If a free trial is offered, any unused portion of the free trial period is forfeited when you purchase a subscription that includes that trial.

Payments

All payments for Calfo Pro are processed by Apple through the App Store. Subscription status is managed on our behalf by RevenueCat. Calfo never receives, sees, or stores your payment card details; Apple handles all payment processing.

Refunds

Because purchases are made through the App Store, refunds are handled by Apple in accordance with Apple's policies. Calfo does not process App Store refunds directly. To request a refund, contact Apple Support.

5. Free and Pro Features

The free tier of Calfo includes barcode scanning, on-device receipt scanning, manual item entry, limited recipe search, and basic nutrition information. Calfo Pro additionally unlocks AI fridge scanning and household sharing. We may change the features included in each tier over time; where a change materially reduces what you have paid for, we will provide reasonable notice.

6. Acceptable Use

You agree not to misuse the Service. In particular, you will not: (a) use the Service in violation of any applicable law; (b) attempt to gain unauthorized access to the Service, other accounts, or our systems; (c) interfere with or disrupt the integrity or performance of the Service; (d) reverse engineer or attempt to extract source code except to the extent permitted by law; or (e) use the Service to upload content that is unlawful or infringes the rights of others.

7. Your Content

You retain ownership of the content you add to Calfo, such as pantry and grocery items, expiry dates, household details, and photos you choose to scan. You grant us a limited license to host, process, and display that content solely to operate and provide the Service to you and, where you use household sharing, to the members of your household. You are responsible for the content you submit.

8. Third-Party Services

Calfo relies on third-party services to deliver certain features, including image analysis, recipe and nutrition data, and barcode lookups. Your use of those features is also subject to the relevant third parties' terms. A full description of which data is shared with which provider is in our Privacy Policy.

9. AI Output, Recipes, and Food Safety

Calfo is an organizational tool, not a food-safety, medical, or nutritional authority. Item identifications from AI image analysis, expiry estimates, recipe suggestions, and nutrition information may be incomplete or inaccurate.

Always use your own judgment and inspect food before consuming it. Do not rely on Calfo to determine whether a food item is safe to eat, or for any decision involving allergies, dietary restrictions, or medical needs. Calfo does not provide medical or professional nutritional advice.

10. Intellectual Property

The Service, including its software, design, branding, and content we provide, is owned by Calfo and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding without our prior written permission. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any information it provides is accurate or complete.

12. Limitation of Liability

To the maximum extent permitted by law, Calfo and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50.

13. Termination

You may stop using the Service at any time and may permanently delete your account and all associated data from within the app. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Davidson County, Nashville, Tennessee, except where applicable law provides otherwise.

16. Apple App Store Terms

The following applies because you obtained Calfo through the Apple App Store:

  • These Terms are between you and Calfo only, not with Apple. Apple is not responsible for the Service or its content.
  • Your license to use Calfo is limited to use on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for the Service.
  • To the extent not covered by the warranty disclaimer above, Apple may refund the purchase price of any unused portion of a subscription where required; Apple has no other warranty obligation with respect to the Service.
  • Apple is not responsible for addressing any claims relating to the Service, including product liability, legal or regulatory compliance, or consumer protection claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Except where these Terms provide otherwise, your use of the app is also governed by Apple's standard Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula.
